Our firm is also instructed by leading insolvency practitioners in Dublin, as well as foreign lawyers, accountants and creditors.

We provide specialist advice in Court Liquidations, Creditors Meetings, Employees’ Rights, Examinerships, Voluntary Liquidations, Receiverships and Corporate Restructuring.

Insolvency Practitioners

Lavelle works with insolvency practitioners in all types of insolvency to assist in maximising the chances of the company, or as much as possible of its business, continuing in existence or if that is not possible to produce the best return for the company’s creditors and members.

Whether it be receivership, examinership, provisional liquidation or liquidation we provide advice prior to the appointment and during the administration on all issues arising. In particular we advise on which form of appointment is appropriate in the circumstances.

In the case of personal insolvencies we advise creditors on the options available to maximise returns. Lavelle also takes instructions from overseas insolvency practitioners looking to recover from Irish concerns.

Shareholders and Directors

We also advise, assist and take appropriate action for creditors, shareholders, guarantors and directors on the many and varied issues which may confront them during an insolvency.


Our team is experienced in all types of litigation arising in the insolvency context. These may be routine winding up applications, appointments of provisional liquidator, examinership, receivership and applications to the Court for directions for an insolvency practitioner, pursuing preference claims or fraudulent lending, reckless trading, Section 150 restrictions of Directors and Section 160 disqualifications of Directors.


Our extensive experience includes not only advising on but preparing commercial documentation to implement solutions to problems as they arise. We work with insolvency practitioners, Directors and shareholders to develop and implement corporate re-organisation and reconstruction.

  • Acting for the Clerys’ concession store owners in a claim against the provisional liquidator, Ciarán Wallace and the vendors of Clerys’ trading company
  • Acting for NAMA and Financial Institutions in proceedings to reverse fraudulent asset transfer
  • Acting on behalf of NAMA Statutory Receivers appointed over various companies and properties and advising the Receivers on an ongoing basis in respect of landlord and tenant matters and general debt recovery and litigation matters
  • Acting for the United States Trustee in Bankruptcy in the bankruptcy of David Drumm and successfully obtained an Order in Aid in the High Court allowing the US bankruptcy to be recognised in Ireland. This was the first application of its kind in Ireland
  • Acting for NAMA in several high value High Court/Commercial Court proceedings against a number of borrowers seeking summary judgment on foot of loan agreements and personal guarantees.
  • Advising NAMA and a PI bank on debt settlement agreements, negotiating and drafting a Deed of Settlement which included a portfolio sale of assets
