We have a state of the art debt recovery software system which allows our clients access to our debt collection system from their own place of business by secure link.

  • View the status of their particular debtor files

We have a specialist security enforcement team. Our team currently acts for a number of mortgage lenders and advise them in mortgage enforcement and possession proceedings.

We work closely with and advise lending institutions on their enforcement options under loan agreements and security documents. We act in a large number of mortgage possession applications on behalf of various lenders in the High Court and Circuit Court. We also advise on the appointment of fixed charge receivers for rent where appropriate.

Our professional negligence team also advise and act for our clients in professional negligence claims and actions to enforce solicitors’ undertakings. This has been effective in perfecting outstanding securities. We assist our clients in relation to reconstitution of security title for the purpose of ensuring enforceability of security.

We represent lending institutions in relation to title insurance arbitration claims. We also advise clients in relation to their legal and commercial options in respect of securitisation of debt and the handling of packages of security and accounts.

Lavelle has begun to offer a Debt Counselling Service for Credit Unions as an alternative to the litigation process. In some instances, instituting legal proceedings is unnecessary and premature and does not serve the interests of either the creditor or the debtor.

Essentially, it is a procedure which focuses on engaging with the debtor to afford them a proper and realistic opportunity to either recommence payments or to enter into a more suitable payment plan. In many cases this will serve as an alternative to court proceedings and will also substantially reduce the costs incurred by both the creditor and the debtor.
