Banking and Financial Services

Our banking and financial services group provide a specialised service in all key areas of banking and financial services work and our clients include domestic and international banks, leading financial institutions, loan acquisition companies and major corporates.

The Group has extensive experience in advising and acting for banks and financial institutions in relation to loan restructures, security documentation, security reviews, enforcements, the appointment of receivers and sales as mortgagee in possession.

The Group also provides advice to a number of institutions involved in the NAMA process and advise NAMA directly.

They are also experienced in undertaking due diligence on distressed asset portfolios in Ireland and acting on the acquisition and disposals of commercial and consumer loan portfolios.

Our Banking and Financial Services team is supported by our other departments to ensure effective and efficient delivery of solutions focused advice.

Our work includes all types of financial transactions and operational issues within the financial markets including:

  • The acquisition by investors of loan portfolios from NAMA
  • Acting for NAMA in successfully obtaining a High Court injunction, against a judgment creditor of a company in NAMA
  • Advising NAMA generally on the enforcement of securities on an ongoing basis
  • Undertaking security reviews, receivership appointments and refinancing/restructuring work for banking institutions
  • Acting for a bank in a number of professional negligence actions
  • Review of security documentation and enforcing solicitors undertakings through the Courts
  • Acting for a number of Receivers appointed by various banks over assets of companies
  • Representing a number of banks in High Court applications for mortgage repossessions
  • Advising a client in the healthcare sector in relation to its group re-financing worth €30 million
  • Acting for developers and lenders in giving and taking security over development, construction and construction agreements, collateral warranties and drafting step-in rights
  • Acting for a number of clients with debts in excess of €100m and advising on the restructuring of their debt
  • Representing a financial services company in relation to a High Court appeal from a decision of the Financial Services Ombudsman. The appeal related to the jurisdiction of the Ombudsman to award compensation to a disgruntled purchaser of UK property
